Social security law

A wide range of social security laws and regulations apply in the Netherlands. This practice area regulates the laws and duties of employers, employees and self-employed people concerning benefits in case of illnesses/disablement and unemployment. The growing number of government laws and regulations in the last few years has complicated social security law. The employer as well as the employee may experience issues in the area of social security law and the services related to it.

Social security law includes:

  • Employment and Assistance Act (de Wet Werk en Bijstand – WWB);
  • Services Act for the Handicapped (de Wet voorzieningen gehandicapten – WVG), currently Social Service Act (de Wet maatschappelijke ondersteuning – WMO);
  • General Child Support Act (Algemene Kinderbijslagwet – AKW);
  • Disablement Services Act for young handicapped people (de Wet arbeidsongeschiktheidsvoorziening jong gehandicapten – WAJONG);
  • Allowances Act (de Toeslagenwet - TW).

National Insurance Law contains:

  • Unemployment Act (de Werkloosheidswet - WW);
  • Disablement Act (Arbeidsongeschiktheidswetgeving – ZW, WAO/WIA etc.)
  • General Pensions Act (de Algemene ouderdomswet – AOW);
  • General Next of Kin Act (de Algemene nabestaande wet - ANW).

You may come in contact with the non-attribution, cancellation or reclamation of a benefit or service, the shortening of a benefit or the payment of a fine.
